Terms of Service

These Terms govern your use of Market FSD. By creating an account, subscribing, or otherwise using the service, you agree to them. If you do not agree, do not use the service. We've tried to keep the language clear — read them.
1. Who we are
Market FSD ("Market FSD," "we," "us," "our") is a signal and decision-support platform operated by bnetdev.com, a business located at 38 W. 20th St, Paris, KY 40361, United States. Questions about these Terms: /contact.php or bbussell@bnetdev.com.
2. What Market FSD is (and is not)
Market FSD produces AI-judged signals, briefs, alerts, and decision-support tools derived from public market data (SEC filings, options flow, technical indicators, insider transactions, and similar sources). Each signal is informational.
Market FSD is not: an investment adviser, broker-dealer, custodian, financial planner, tax adviser, accountant, attorney, or fiduciary of any kind. We do not provide personalized investment advice. Nothing delivered through the service — including AI-generated rationales — constitutes a recommendation to buy, sell, or hold any security. See the Disclaimer for full risk framing.
3. Eligibility
You must be at least 18 years old and legally able to enter into binding contracts in your jurisdiction. The service is offered primarily to residents of the United States. You are responsible for ensuring your use of the service complies with local laws and financial regulations applicable to you.
4. Accounts & security
To use the service you create an account with a valid email address and password. You are responsible for safeguarding your credentials and for every action taken under your account. Notify us immediately at bbussell@bnetdev.com if you suspect unauthorized access.
5. Subscriptions, billing, and the 30-day money-back guarantee
Pricing & tiers
Market FSD is offered in subscription tiers — Signals, Connected, and FSD — at the monthly prices shown on our Pricing page. Prices may change; your existing subscription continues at the price in effect when you subscribed until the start of your next billing cycle after we notify you of a change.
Billing provider
Subscriptions are billed through PayPal. We do not store or process your payment card details. PayPal's terms and privacy policy apply to the payment transaction.
7-day free trial
Every new subscription includes a 7-day free trial. You will not be charged during the trial. If you do not cancel before the trial ends, the first billing period will begin automatically and you will be charged the tier's monthly price.
30-day money-back guarantee
If, within 30 days of your first paid charge, you decide Market FSD is not for you, cancel your subscription and email bbussell@bnetdev.com to request a refund of that first paid charge. We will process the refund promptly. The guarantee applies to your first paid subscription period only; renewals beyond that period are not eligible.
Cancellation
You may cancel at any time from your PayPal dashboard or by contacting us. Cancellation stops future renewals. Aside from the 30-day guarantee above, partial-month refunds are not provided. After cancellation you retain access through the end of the period you already paid for.
6. Non-custodial model — we never hold your money
Market FSD never holds, receives, transfers, or takes custody of your funds. Your capital remains in your own brokerage account (Tradier, or whichever broker you use), which is SIPC-insured and regulated by the SEC, FINRA, and/or equivalent authorities.
On the FSD tier, you provide us with an API token issued by your broker that authorizes us to place buy and sell orders on your behalf. Our access is trade-only; we cannot withdraw, transfer, or move funds. You may revoke the token from your broker's dashboard at any time, which immediately terminates our access.
7. Your responsibilities
- You are solely responsible for every trade placed in your brokerage account, whether placed by you manually or by FSD at your authorization.
- You are responsible for verifying that any trade is appropriate for your financial situation, risk tolerance, tax status, and regulatory obligations.
- You are responsible for compliance with your broker's terms, margin requirements, pattern-day-trader rules, and all applicable law.
- You are responsible for keeping your account credentials and API tokens secure.
8. Third-party services
The service integrates with third-party providers including (but not limited to) Tradier (brokerage API), PayPal (billing), Postmark (email delivery), and public data sources such as the SEC EDGAR system. Your use of those third-party services is also governed by their respective terms and privacy policies. We are not responsible for third-party service outages, errors, or changes.
9. Acceptable use
You agree not to:
- Reverse engineer, scrape, or redistribute signals, data, or content from the service.
- Resell or sublicense access to your account.
- Use the service to engage in market manipulation, insider trading, or any illegal activity.
- Interfere with the service's security, availability, or other users' use.
- Create accounts by automated means or using false information.
10. Intellectual property
All software, content, signals, briefs, prompts, rankings, and data structures produced by or for Market FSD are the property of bnetdev.com and/or its licensors and are protected by copyright and other intellectual-property laws. We grant you a limited, personal, non-transferable, non-exclusive license to use the service for your own trading decisions during your subscription. No other rights are granted.
11. Termination
We may suspend or terminate your account if you violate these Terms, engage in fraud or abuse, create risk for us or other users, or fail to pay. You may close your account at any time. Termination does not relieve you of fees already owed.
12. Disclaimers — as-is service
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF DEALING. We do not warrant that signals are accurate, that the service will be uninterrupted or error-free, or that any trade based on a signal will be profitable.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MARKET FSD, BNETDEV.COM, AND THEIR OPERATORS, CONTRIBUTORS, LICENSORS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, TRADING LOSSES, LOST DATA, OR COST OF SUBSTITUTE SERVICES, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (b) ONE HUNDRED U.S. DOLLARS ($100).
14. Indemnification
You agree to defend, indemnify, and hold harmless Market FSD, bnetdev.com, and their operators from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to (i) your use of the service, (ii) your trades, (iii) your violation of these Terms, or (iv) your violation of any law or third-party right.
15. Governing law & venue
These Terms and any dispute arising from or related to them are governed by the laws of the Commonwealth of Kentucky, USA, without regard to conflict-of-law principles. You agree that the exclusive venue for any judicial action or proceeding shall be the state or federal courts located in Bourbon County, Kentucky, and you consent to personal jurisdiction in those courts.
16. Dispute resolution — informal first, then arbitration
Before filing any formal action, you agree to contact us in writing at bbussell@bnetdev.com and allow us 30 days to attempt resolution. If the dispute is not resolved, both parties agree to resolve any remaining dispute through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, with the seat of arbitration in Bourbon County, Kentucky. The arbitrator's decision is final and may be entered as a judgment in any court of competent jurisdiction. Either party may still bring an individual action in small-claims court in lieu of arbitration.
17. Class-action waiver
To the extent permitted by law, you and we agree that any dispute will be resolved on an individual basis only and not as a class, collective, or representative action.
18. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced by email or through the service at least 15 days before they take effect. Continued use of the service after the effective date of the change constitutes acceptance of the updated Terms.
19. Miscellaneous
If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. Our failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our written consent; we may assign ours in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy and Disclaimer, constitute the entire agreement between you and us regarding the service.
