Market FSD is non-custodial: your funds stay in your own SIPC-insured, SEC-regulated brokerage account at all times. We never hold, receive, or take custody of client money. On the FSD tier, we send trade instructions to your broker via an API token you control. See Terms, Section 6.

4. Past performance is not indicative of future results

Any performance shown — live, paper, backtested, or hypothetical — reflects prior market conditions and specific choices made at a specific time. Past performance does not guarantee future results and should not be relied on as a forecast of the performance you will achieve. Paper-trading results can diverge materially from live-account results due to slippage, fill delays, locate availability, commissions, liquidity, and market microstructure.

5. Hypothetical and paper-trading results

Paper or hypothetical results have inherent limitations. Unlike an actual trading record, such results do not represent real trading and generally do not account for the financial risk of live trading, the psychological pressure that affects real decisions, or the execution challenges of live markets. No representation is made that any account will or is likely to achieve results similar to those shown.

6. Options, shorts, and leveraged instruments — amplified risk

Trading in options, short positions, inverse ETFs, leveraged ETFs, and daily-rebalancing products carries additional and amplified risks, including the potential for losses that exceed your initial investment. These instruments are not suitable for every investor. You should consult your broker's risk disclosures and, if offered, the OCC's Characteristics and Risks of Standardized Options before trading options.

7. Automated execution on the FSD tier

When you enable automated execution via Tradier or another supported broker, trades are placed in your brokerage account by your direction and under your authority. You remain solely responsible for all resulting positions and outcomes. Market FSD provides configurable safety controls (kill switch, loss limits, sandbox mode), but those controls are limits you set — they do not guarantee prevention of loss.

8. AI-generated content — may be wrong

Our signals and briefs are produced by AI analysis of public market data. AI systems can make mistakes, misread filings, miss context, or produce confidently incorrect output. Every AI-generated rationale should be read critically; verify the underlying data and apply your own judgment before acting. Do not outsource your decisions to the AI.

9. No guarantee of accuracy or availability

We make no guarantee that signals, prices, filings, options flow, or other data shown are accurate, complete, timely, or free from error. Data sources can delay, misreport, or correct their feeds without notice. We make no guarantee that the service will be uninterrupted or available at any particular time.

10. No testimonials currently; no endorsements

Market FSD does not presently publish customer testimonials or endorsements. Should we do so in the future, testimonials will be identified as such, and individual results portrayed will not be representative of the results all customers will achieve.

11. Jurisdictional note

Market FSD is operated from the Commonwealth of Kentucky, United States, and intended for residents of the United States. Securities laws vary by jurisdiction.
